1. Acceptance of Terms

By creating an account, downloading, or using Trivia Terminal, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. These Terms constitute a legally binding agreement between you and Trivia Terminal.

2. Eligibility

You must meet the following requirements to use our Service:

• Have the legal capacity to enter into these Terms
• Not be prohibited from using the Service under applicable laws
• Maintain only one account per person

• Reverse engineer, decompile, or disassemble any part of the Service
• Use automated scripts, bots, or other automated means to access the Service
• Attempt to gain unauthorized access to our systems or other users' accounts
• Interfere with or disrupt the Service or servers
• Upload or transmit viruses, malware, or other malicious code
• Harass, threaten, or harm other users
• Impersonate any person or entity
• Collect or harvest information about other users without consent

5.1 In-App Purchases

Trivia Terminal offers premium features available through in-app purchases processed by Stripe. By making a purchase, you agree to pay the stated price and any applicable taxes.

5.2 Refund Policy

All purchases are final and non-refundable except where required by law. If you believe you are entitled to a refund, please contact us at support@trivieterminal.com within 14 days of purchase.

5.3 Price Changes

We reserve the right to modify pricing for premium features at any time. Price changes will not affect existing purchases.

6. Intellectual Property Rights

6.1 Our Content

All content, features, and functionality of Trivia Terminal, including but not limited to:

• Text, graphics, logos, icons, and images
• Software code and algorithms
• Game mechanics and designs
• Trivia questions and answer formats
• Audio and visual elements

are owned by or licensed to Trivia Terminal and are protected by copyright, trademark, and other intellectual property laws.

6.2 Limited License

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use Trivia Terminal for personal, non-commercial use only. This license does not include:

• Any resale or commercial use of the Service
• Downloading or copying account information for the benefit of another
• Use of data mining, robots, or similar data gathering tools
• Any derivative use of the Service or its contents

6.3 User-Submitted Content

Premium users may submit links to articles for trivia question generation. By submitting content, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and distribute the submitted content for the purpose of generating trivia questions and operating the Service.

7. Trivia Content and Sources

7.1 AI-Generated Questions

Trivia questions are generated using artificial intelligence based on news articles and other sources. While we strive for accuracy, we do not guarantee that all questions and answers are 100% accurate or up-to-date.

7.2 Third-Party Sources

Questions may be based on content from third-party news sources. We provide source links for educational purposes. We are not responsible for the accuracy, availability, or content of third-party websites.

8. Leaderboards and Rankings

8.1 Leaderboard Rules

Leaderboards display user scores and rankings based on game performance. We reserve the right to:

• Remove users from leaderboards if cheating is detected
• Reset leaderboards periodically
• Modify leaderboard algorithms and scoring systems
• Display or hide user information on leaderboards

8.2 No Guarantees

Leaderboard rankings are provided for entertainment purposes only. We make no guarantees about leaderboard accuracy or availability.

9. Disclaimers and Limitations of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TRIVIA TERMINAL SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATING TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRIOR TO THE EVENT GIVING RISE TO LIABILITY, OR $100 USD, WHICHEVER IS GREATER.

10. Indemnification

You agree to indemnify, defend, and hold harmless Trivia Terminal, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with:

• Your access to or use of the Service
• Your violation of these Terms
• Your violation of any third-party rights
• Any content you submit or share through the Service

11. Termination

11.1 By You

You may terminate your account at any time through the app's profile settings. Upon termination, your right to use the Service will immediately cease.

11.2 By Us

We may suspend or terminate your account at any time, with or without notice, for any reason, including if:

• You violate these Terms
• You engage in cheating or unfair play
• Your account has been inactive for an extended period
• We cease offering the Service
• We determine that your actions harm the Service or other users

11.3 Effect of Termination

Upon termination, your account data will be deleted in accordance with our Privacy Policy. Some anonymized game statistics may be retained for leaderboard integrity.

12. Modifications to Terms

We reserve the right to modify these Terms at any time. When we make material changes, we will notify you by:

• Posting the updated Terms in the app
• Updating the "Last Updated" date
• Sending you a push notification (if enabled)

Your continued use of the Service after changes become effective constitutes acceptance of the modified Terms. If you do not agree to the modified Terms, you must stop using the Service.

13. Governing Law and Dispute Resolution

13.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.

13.2 Dispute Resolution

Any disputes arising from or relating to these Terms or the Service shall be resolved through binding arbitration, except that either party may seek injunctive relief in court to prevent infringement of intellectual property rights.

13.3 Class Action Waiver

You agree that any arbitration or proceeding shall be limited to the dispute between you and Trivia Terminal individually. To the full extent permitted by law, no arbitration or proceeding shall be joined with any other, and there is no right for any dispute to be arbitrated on a class-action basis.

14. General Provisions

14.1 Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.

14.2 Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

14.3 Assignment

You may not assign or transfer these Terms or your rights hereunder without our prior written consent. We may assign these Terms without restriction.

14.4 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Trivia Terminal regarding the Service and supersede all prior agreements.

14.5 Force Majeure

We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to acts of God, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, network infrastructure failures, strikes, or shortages of transportation facilities, fuel, energy, labor, or materials.
